Terms and Conditions
Artin Education is an Australian Business (ABN: 56 615 928 639) operating in Melbourne, Victoria.
Throughout this document, Bob Zhu and Ming Lian are defined as the ‘Head Tutors’, ‘We’ and ‘Our’ refers to Artin Education and its Employees and Contractors, ‘You’ and ‘Your’ refers to the client either reading this or receiving our services.
‘On Site’ refers to being present at the Artin Education tuition space on 2/710 High Street Road, Glen Waverley, VIC 3150, Australia.
This agreement outlines the terms and conditions for the services provided to you by our business.
Artin Education offers the following subjects for tuition:
Mathematics Tuition (‘Maths’); and
English Tuition (‘English’).
Artin Education offers the following year levels tuition for both Maths and English:
Year 5 and 6, in particular but not restricted to High School Scholarship Preparation; and
Years 7 to 10; and
VCE ½ and ¾.
On special request and in unusual circumstances, Artin Education may tutor students outside of this year level range, although it is at the discretion of the Head Tutors.
Artin Education offers the following classes for tuition:
Private (One on One) Individual Tuition (‘Private’), which is defined as Maths or English tuition for individual students, with a fee of $80 per hour; and
Small Group Tuition (‘Group’), which is defined as Maths or English tuition for two or more students up to six, with a fee of $50 per hour; and
Class Tuition (‘Class’), which is defined as Maths or English tuition for seven or more students up to sixteen, with a fee of $40 per hour.
Artin Education uses the following software to aid and enhance teaching:
Trello, a learning management system; and
Fleeq.io, an online video platform and quizzing tool
If a student is unable to get access to Trello, hardcopies can be provided at an additional printing fee of $10 per class.
Artin Education does offer a complimentary initial consultation session (‘Initial Assessment’) which runs for approximately 30 minutes prior to the first lesson for specific types of class:
Only Private and Small Group Tuition will be offered the Initial Assessment. Class Tuition students will not be eligible for the Initial Assessment.
As part of the Initial Assessment, Artin Education reserves the right, at its discretion, to reject students or add them onto the waiting list.
For Group and Class Tuition, all new students commencing at Artin Education receive their first lesson free.
The Initial Assessment in Group Tuition does stack with the first lesson free policy.
As a member of the Australian Tutoring Association (‘ATA’), Artin Education is bound by the ATA Code of Conduct – we are able to provide a copy of the latest ATA Code of Conduct upon request – and we adhere to each section. We are obliged to:
Use our resources for the best educational outcomes for students;
Use our teaching and learning practices to enhance student’s self-esteem and confidence to learn; and
Use our skills to the best of their ability to teach students so that you improve in the subjects in which you receive tuition.
Terms of Payment
Artin Education will only charge a tuition fee (‘Tuition’) – there is no enrolment fee.
All payments are non-negotiable – no discounts are available.
Tuition payments differ depending on the time period in which a student is enrolled with Artin Education:
Prior to the 1st of January, 2019, Tuition will be charged according to the previous rates set by the Head Tutors, in adherence with their yearly Tuition-setting policy.
Post 1st of January, 2019, Tuition will be standardised and set based on whether it is considered Private, Group or Class.
In the case of Private Tuition, payments can be made on either a weekly (‘As You Go’) basis or per ten-week term (‘Term’). To lock in a place for Private Tuition, a Term payment must be made in advance of the first lesson.
In the case of Group Tuition, payments must be made on a Term basis, prior to the free first lesson. You will be entitled to a full refund at the end of the first free lesson for new students, assuming you were not satisfied with it. This will guarantee a student is locked in place for Group Tuition over the Term.
In the case of Class Tuition, payments must be made on a Term basis, prior to the first lesson. You will be entitled to a full refund at the end of the first free lesson for new students, assuming you were not satisfied with it. This will guarantee a student is locked in place for Class Tuition over the Term.
Payments made As You Go are not subject to the fee structure outlined above. Students who wish to make such payments will be charged $100 per hour, as each missed lesson is a waste of the tutor’s time and resources.
Term payments reflect a 10 week term. Outside of the 10 weeks, including during holidays, payments can be made As You Go without any penalties, provided that the student has committed to attending the class.
Artin Education offers a Cooling Off Period (‘Cooling Period’), up to one week from the initial payment of a Term of Tuition, we will refund all payments no questions asked. Payments made As You Go are not subject to the Cooling Period.
One week before the end of a Term, you will be asked whether or not you want to continue with a following Term of Tuition.
Artin Education accepts payments via the following methods:

Please ensure you include your students name(s) and year level as part of the payment. For example, “James X Yr 9”.
EFTPOS – On Site. Please note that any EFTPOS payment will incur a 1.9% surcharge, as Square Payments charges a surcharge on all payments made on its EFTPOS reader.
Cash – On Site.
Artin Education will provide an invoice for Term Tuition payments when you are next On Site.
Payments must then be received prior to the commencement of the first lesson, or if payment is to be made in cash, prior to the end of the first lesson.
Past invoices can be provided upon request.
Consistent with our ATA membership, Artin Education offers a written refund policy (‘Refund Policy’) for all clients.
We acknowledge all clients do have the right to a refund if there has been a breach of statutory conditions – Competition and Consumer Act 2010 (Cth). Such conditions include working with appropriate care and skill and providing the level of service promised or advertised.
The Refund Policy is separate from the Cooling Period, and only takes effect once the Cooling Period has expired and after one week of a Term of lessons or classes has been attended. Refunds are offered on a pro-rata basis, based on the number of remaining lessons in a Term.
Only classes that have not been attended are eligible to a refund in each Term and are not recorded. This excludes lessons that are missed despite being booked and confirmed verbally, via email or mobile; at least 24 hours of notice must be provided for cancellation of a lesson, or else the Refund Policy will not apply.
At the discretion of Artin Education, and on a case-by-case basis, we may offer a refund if less than 24 hours of notice is provided for cancellation, provided there was an emergency or other extenuating circumstances.
If a student or parent of that student provides more than 24 hour notice and no make-up class can be arranged, the lesson credits will be carried over into the following term.
All Group and Class lessons are recorded, and homework/resources can be emailed, therefore any missed lessons without prior notice or cancellation will not be refunded.
An administration fee of $10 per refunded class will be applied in order to reflect the time taken to process the refund, to confirm and agree on the amount of refunded classes, and also to account for the existing classes, materials and resources that have already been provided.
The calculation for the refund is calculated using an example: assuming $400 was paid for Term Tuition and exactly three lessons have been attended, then you will be eligible to a refund of 7 * $40 minus 7 * $10, or $210 ($280-$70). This is because, on average, each lesson in a Term is $40, and seven lessons are remaining in the Term. The administration fee of $10 per refunded class has then been applied.
As You Go Tuition students will not be eligible to the Refund Policy.
To enrol a student, parents must fill in an enrolment form that asks for basic information and emergency contact details.
Upon enrolment, students are required to set up a Trello account, the learning management system used by Artin Education. If desired, parents are also allowed to set up a Trello account to keep track of the student’s progress.
Code of conduct
All Artin Education students are required to behave in a respectful manner towards students and Artin Education tutors at all times.
If students become a nuisance in the classroom and proves to be too difficult to control, they can be asked to leave.
Students must not unlawfully reproduce, publish, distribute or provide access to any Artin Education materials.
Students must complete their assigned homework or provide a valid reason for why the homework was not submitted, either in person or on Trello.
Students who consistently fail to complete homework will have their parents receive a warning.
If this behaviour continues, Artin Education reserves the right to terminate the student, and will provide a refund for any remaining planned lessons.
Consistent with our ATA membership, we have comply with the Privacy Act (1988) (Cth) and adhere to the National Privacy Principles.
Information in client files, including assessment, attendance, behavioural observations, billing, reports and personal details can all be made available for the client’s perusal upon request.
All tutors are certified with Working With Children Checks (‘WWCC’).
Artin Education specifically examines the credentials of each tutor outside of Head Tutors, we hire very deliberately and only via invitation – while tutors may submit applications, we do not openly recruit or have an ongoing recruitment process.
We do not guarantee, represent or warrant that each Term of Tuition will be uninterrupted or error-free. We will try to the best of our ability to ensure any interruptions and errors are quickly remedied – either by offering free replacement lessons or free replacement notes.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. We will never openly guarantee or commit to providing any student a specific score or result; we will perform to the very best of our ability to help students secure the results or expectations they are seeking.
In no case shall Artin Education, our partners, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Artin Education reserves the right at any time to change, suspend or terminate the services (or any part thereof), and/or use of or access to them, with notice.
Artin Education may also remove, or bar access to, all related information and files.
Artin Education will not be liable to Users or any third-party for any change, suspension, or termination of service, or loss of related information.
Artin Education may amend these Terms and Conditions at any time by posting the amended terms on www.artineducation.com.au (‘Website’). The current terms will always be available on the Website.
Neither party shall be liable to the other for any loss, damage, delay or failure of performance, that is caused by an act or event beyond its reasonable control, including but not limited to, acts of God, civil disturbances, war, strikes, emergency laws, regulations or governmental proclamations, or acts or failure to act of any governmental entity (‘Force Majeure’).
Artin Education is open to clients who join the course late, assuming Private, Group and Class Tuition sessions are not at maximum capacity.
As specified in Terms of Payments, Term Tuition lessons can be terminated at any time and will fall into part of the Refund Policy.
